APRIL 17TH, 2015 approval of the new PIANO CASA in Sardinia
The so called “Piano Casa” is a special law about the simplification and reorganisation of the provisions on planning and construction and improvement of building heritage. One of its main purposes is to provide forms of facilitation, through increases in volume, for the improvement of architectural quality and efficiency of the already existing buildings. Today we will try to clarify how and where these increases in volume are possible: the most eagerly awaited news concern, in fact, the volumetric gains that will be possible until December 31st , 2016 in the urban areas A, B, C, D, E, F and G.
A – In the historical centres, urban area A, the volumetric increase is 20%, up to a maximum of 70 cubic meters. In this case it imposed a five-year bond that excludes the possibility of selling the asset.
B, C – In residential areas and building expansion areas (B and C) you will be able to produce building works for a maximum of 20% (up to 90 cubic meters, more than 33 square meters) in the coastal municipalities, who have not adapt the PUC (Piano urbanistico comunale) to the PPR (Piano paesaggistico regionale), i.e. most of the municipalities of the island.
In residential areas and building expansion areas (B and C), that have adjusted the two planning instruments (PUC and PPR), in non-coastal municipalities you can get instead a maximum increase of 30% (up to 120 cubic meters, that is 45 square meters)
For these three cases there is a further increase of 5%, if the project includes works to improve energy efficiency, implementation of green roofs and vertical gardens or interventions of reuse of stormwater and wastewater.
Also, they can be built spaces, as a main residence, for the disabled for up to 120 cubic meters. This possibility can not be combined with the proposed increases in areas A, B and C.
In order to increase the volumes of existing dwellings, people, however, they must have at least one private parking (Article 12). The provision do not apply to buildings in the historic centres.
D – In industrial and artisanal areas (D) you can increase the plants and other structures, closely connected with the production activity (not so homes or commercial parts), for a maximum of 25% of the existing volume. In D areas, but to commercial destination, the increase can be limited to 20%, to a maximum of 400 cubic meters.
E – In agricultural areas you can provide volumetric expansion, as those applicable to residential B and C areas, beyond the range of a kilometre from the shore line (300 meters to the smaller islands), for already existing buildings to December 31st , 2014.
Hotel and Hotel facilities (Article 31):
No volumetric gains for hotels on the sea (within 300 meters from the shoreline) as long as they are located outside the cities. Yes, instead, to all the other buildings, located in various areas, except for the structures in the historical centres, far from the sea. We are speaking about a maximum of 25% of new cement, without increasing the number of beds. Besides, 30% of the increase will be used for the adjustment of hotel rooms to international standards. Outside of 300 meters from the sea, extensions concern residential areas (B and C), the tourist areas (F) and those for services (G).
Attics and lofts (Article 32):
The law also encourages the reuse and recovery of existing attics – with limitations in the city centres – and the construction of mezzanines.
Demolition and reconstruction:
In order to preserve the areas of special landscape value or to secure the territory, the Law provides, for the demolition and reconstruction of buildings, a volumetric bonus up to a maximum of 40%.
In order to build a residential facility in the country, you must have a minimum area of at least three hectares, and you need to be a farmer. In case of legal persons, companies must work mainly in agricultural activities.
Penalties (Article 6):
The penalties for the efforts made, in the absence of permission to build, total deviations or essential variations are very hard: they go by the fall of the works to the seizure and confiscation of the construction yard (with properties that become part of public property ). Assuming the proven continuation of the works, there will be the complete demolition.
